Terms of Service

The agreement between you and ODHOST for web hosting, VPS and servers: accounts, orders, renewals, late payment, cancellations and responsibilities.

Last updated Version 1

These Terms of Service ("Terms") are an agreement between you and ODHOST, a unit of Nishita Solutions ("ODHOST", "we", "us"), with its registered place of business at Plot No. 43/36/37/38/39/10, Khata No. 1, Bhagabati, Betnoti, near Betnoti Laxmi Narayan Mandir, Mayurbhanj, Odisha 757025, India and its office at SB-18, near Durga Mandap, Dayanandnagar, Bomikhal, Rasulgarh, Bhubaneswar, Odisha 751010, India. They apply when you create an ODHOST account, order a service or use any ODHOST website, control panel or server.

Your account

  • Give us accurate details, including a working email address. We sign you in with one-time codes sent to that address, so keep your email account secure.
  • You are responsible for everything done through your account. Tell us at once if you think someone else has used it.
  • If you create an account for a business, you confirm that you may accept these Terms for it. You must be at least 18 years old.

Our services

  • Each plan includes the resources and features described on its plan page when you order. Plan limits (websites, storage, mailboxes, databases and so on) apply to the whole account.
  • "Unlimited" bandwidth means there is no fixed monthly transfer cap, subject to fair use: an account must not affect other customers or the stability of a shared server.
  • We may change the software, hardware or servers used to provide a service, as long as the plan features you pay for stay the same.
  • We carry out maintenance from time to time and give notice where we reasonably can. We work to keep services available but cannot promise they will never be interrupted.

Orders, prices and payment

  • Prices are in Indian rupees. GST is added as shown on your invoice.
  • Services are billed in advance for the billing period you choose (monthly or yearly).
  • A service is set up after payment is confirmed. Orders may be checked before setup; we can cancel an order and refund it in full if we cannot accept it.
  • You can pay online through our payment partner, by UPI or bank transfer, or from account credit.

Renewals and late payment

  • Services renew automatically for the same period unless you switch off auto-renew or cancel. We send the renewal invoice and reminders before the due date.
  • If an invoice is not paid, the service may be suspended 5 days after the due date and will be restored when the invoice is paid.
  • A service that stays unpaid may be terminated from 30 days after the due date. Its data may then be deleted permanently.

Changing plans

  • Upgrades take effect straight away. You pay the difference for the rest of the current period.
  • Downgrades take effect at the next renewal, and only if your usage fits the smaller plan.

Cancelling

You can cancel from your account, either at the end of the billing period or immediately. Refunds follow our Refund Policy.

Your responsibilities

  • Follow our Acceptable Use Policy.
  • You are responsible for the content of your websites and email, and for keeping your applications, plugins and passwords up to date.
  • We take weekly backups of shared hosting, but backups can fail or be incomplete. Keep your own copies of anything important.

Suspension and termination by us

We may suspend or terminate a service, with notice where possible, if:

  • an invoice is overdue;
  • the service breaks these Terms or the Acceptable Use Policy;
  • it puts our systems or other customers at risk; or
  • the law, a court or a government authority requires it.

Your data

Your content belongs to you. We access it only to provide and support the service, to keep our systems secure, or when the law requires it. Our Privacy Policy explains how we handle personal information. Download your data before a service ends: after termination it may be deleted and cannot be recovered.

Liability

  • We are not liable for indirect or consequential loss, such as lost profits, lost data or lost business.
  • Our total liability for any claim is limited to the amount you paid us for the affected service in the three months before the claim.
  • Nothing in these Terms limits liability that cannot be limited under Indian law.

Changes to these Terms

We may update these Terms. We will tell you about important changes by email or in your account. Where a change needs your agreement, we will ask you to accept the new version the next time you sign in.

Law and disputes

These Terms are governed by the laws of India. Courts in Bhubaneswar, Odisha have jurisdiction over any dispute.
